Privacy policy

Privacy Policy

The following Privacy Policy defines the rules for storing and accessing data on Users' Devices using the Service for electronic service provision by the Administrator and the rules for collecting and processing Users' personal data provided by them personally and voluntarily through the tools available in the Service.

This Privacy Policy is an integral part of the Service Terms and Conditions, which specify the rules, rights, and obligations of Users using the Service.

§1 Definitions

  • Service – the "cyberapis.pl" website operating at https://cyberapis.tojest.dev

  • External Service – websites of partners, service providers, or clients cooperating with the Administrator

  • Service/Data Administrator – the entity providing electronic services via the Service

  • User – any natural person for whom the Administrator provides services electronically via the Service.

  • Device – an electronic device along with software through which the User accesses the Service

  • Cookies – text data collected in the form of files placed on the User's Device

  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation)

  • Personal Data – information about an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more specific factors defining physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person

  • Processing – an operation or set of operations performed on personal data or sets of personal data, whether automated or not, such as collecting, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing, or destroying

  • Restriction of Processing – marking stored personal data to limit their future processing

  • Profiling – any form of automated processing of personal data consisting of using personal data to evaluate certain personal aspects relating to a natural person, particularly to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements

  • Consent – any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which they, by a statement or clear affirmative action, signify agreement to the processing of personal data relating to them

  • Personal Data Breach – a breach of security leading to accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed

  • Pseudonymization – processing personal data in such a way that they can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures ensuring that the personal data are not attributed to an identified or identifiable natural person

  • Anonymization – an irreversible process that destroys or overwrites personal data, making it impossible to identify or associate a given record with a specific user or individual

§2 Data Protection Officer

Based on Article 37 of the GDPR, the Administrator has not appointed a Data Protection Officer.

For matters related to data processing, including personal data, please contact the Administrator directly.

§3 Types of Cookies

  • Internal Cookies – files placed and read from the User's Device by the Service's IT system

  • External Cookies – files placed and read from the User's Device by IT systems of external services. Scripts of external services that may place cookies on the User's Device have been deliberately placed in the Service through scripts and services made available and installed in the Service

  • Session Cookies – files placed and read from the User's Device by the Service during one session of a given Device. After the session ends, the files are deleted from the User's Device.

  • Persistent Cookies – files placed and read from the User's Device by the Service until they are manually deleted. The files are not deleted automatically after the Device session ends unless the User's Device settings are set to delete cookies after the Device session ends.

§4 Data Storage Security

  • Mechanisms for Storing and Reading Cookies – the mechanisms for storing, reading, and exchanging data between Cookies stored on the User's Device and the Service are implemented through built-in browser mechanisms and do not allow for the collection of other data from the User's Device or data from other websites visited by the User, including personal data or confidential information. Transferring viruses, trojans, and other worms to the User's Device is also practically impossible.

  • Internal Cookies – the Cookies used by the Administrator are safe for Users' Devices and do not contain scripts, content, or information that could threaten the security of personal data or the security of the Device used by the User.

  • External Cookies – the Administrator makes every possible effort to verify and select Service partners in terms of Users' security. The Administrator selects well-known, reputable partners for cooperation. However, he does not have full control over the content of Cookies from external partners. The Administrator is not responsible for the security of Cookie files, their content, or lawful use by scripts installed in the Service originating from external services, to the extent permitted by law. A list of partners is provided later in the Privacy Policy.

  • Cookie Control

  • User-Side Threats – the Administrator uses all possible technical measures to ensure the security of data placed in Cookie files. However, it should be noted that ensuring the security of these data depends on both parties, including the User's activity. The Administrator is not responsible for intercepting these data, impersonating the User's session, or deleting them due to the User's conscious or unconscious activity, viruses, trojans, and other spyware that may infect the User's Device. Users should follow safe internet usage recommendations to protect themselves from these threats.

  • Personal Data Storage – the Administrator ensures that every effort is made to secure personal data voluntarily provided by Users, that access to them is limited and carried out according to their purpose and processing objectives. The Administrator also ensures that every effort is made to secure the data held against loss by using appropriate physical and organizational security measures.

  • Password Storage – the Administrator states that passwords are stored in encrypted form, using the latest standards and guidelines in this regard. Decrypting passwords provided in the Service for account access is practically impossible.

§5 Purposes for Using Cookie Files

  • Improving and facilitating access to the Service
  • Personalizing the Service for Users
  • Enabling login to the Service
  • Marketing and remarketing on external services
  • Advertising services
  • Affiliate services
  • Conducting statistics (users, number of visits, types of devices, connections, etc.)
  • Serving multimedia services
  • Providing social networking services

§6 Purposes of Personal Data Processing

Personal data voluntarily provided by Users are processed for one of the following purposes:

  • Provision of electronic services:
    • Registration and maintenance of a User account in the Service and related functionalities
    • Newsletter service (including sending advertising content with consent)
    • Commenting/liking entries in the Service without the need to register
    • Sharing information about content posted in the Service on social networks or other websites
  • Communication between the Administrator and Users regarding the Service and data protection
  • Ensuring the legitimate interest of the Administrator

Data about Users collected anonymously and automatically are processed for one of the following purposes:

  • Conducting statistics
  • Remarketing
  • Serving advertisements tailored to Users' preferences
  • Handling affiliate programs
  • Ensuring the legitimate interest of the Administrator

§7 External Services' Cookie Files

The Administrator uses JavaScript scripts and web components of partners in the Service who may place their own cookies on the User's Device. Remember that you can decide on the allowed cookies that can be used by individual websites in your browser settings. Below is a list of partners or their services implemented in the Service that may place cookie files:

Services provided by third parties are beyond the control of the Administrator. These entities may change their terms of service, privacy policies, data processing purposes, and methods of using cookies at any time.

§15 Service Requirements

  • Restricting the storage and access to Cookies on the User's Device may cause some Service functionalities to malfunction.

  • The Administrator is not responsible for improperly functioning Service functionalities if the User restricts in any way the ability to save and read Cookie files.

§16 External Links

In the Service—articles, posts, entries, or User comments—there may be links to external websites with which the Service Owner does not cooperate. These links and the pages or files indicated under them may be dangerous for your Device or pose a threat to the security of your data. The Administrator is not responsible for the content found outside the Service.

§17 Changes to the Privacy Policy

  • The Administrator reserves the right to change this Privacy Policy at any time without notifying Users regarding the use and application of anonymous data or the use of Cookie files.

  • The Administrator reserves the right to change this Privacy Policy at any time regarding the processing of Personal Data, about which he will inform Users with user accounts or subscribed to the newsletter via email within 7 days from the change of provisions. Continued use of services implies familiarity and acceptance of the introduced changes to the Privacy Policy. If the User does not agree with the introduced changes, they are obliged to delete their account from the Service or unsubscribe from the Newsletter service.

  • The changes introduced to the Privacy Policy will be published on this subpage of the Service.

  • The changes come into effect upon their publication.
